Terms of Service

1. Who these terms are with#

Bidstitch is provided by Bidstitch App Inc. (“Bidstitch”, “we”, “us”, “our”). These terms are an agreement between you and us.

By using Bidstitch you agree to these terms. If you do not agree, do not use the app.

Our Privacy Policy explains what we do with your data and forms part of this agreement.

2. What Bidstitch is, and what its valuations are not#

Bidstitch takes photographs of clothing and uses artificial intelligence to try to identify the piece and estimate what it might be worth. It also lets you keep the pieces you have scanned in My Closet and in your scan history, see an estimate for your collection as a whole, and share a card about a piece or your closet.

Read this part carefully, because it is the most important thing in these terms.

  • Every value Bidstitch shows you is an estimate produced by an AI model. It is not an appraisal. It is not made by a qualified appraiser, it is not made by anyone who has held the item, and it is not a professional opinion of value.
  • It is not financial, investment, tax, or insurance advice, and nothing in the app is a recommendation to buy, sell, hold, or insure anything.
  • It is not an offer, a guarantee, or a promise that anyone will pay that price, including us. We do not buy or sell anything through the app.
  • It can be wrong. AI models misidentify garments, confuse reproductions with originals, get eras and brands wrong, and produce prices that do not reflect what an item would actually sell for. Estimates depend on the photographs you take, on the sale data available at the time, and on the model we happen to be using, which we change.
  • It is not an authentication. Bidstitch does not verify that a garment is genuine.

If money depends on the answer, get a real appraisal or authentication from a qualified professional. You decide what to do with an estimate, and you carry the consequences of that decision.

Where the app shows a price history or a chart of value over time, the same applies. It is a modelled estimate, not a record of real sales of your item.

3. Your account, and how old you have to be#

You must be at least 16 years old to use Bidstitch. If you are under 16, do not use it.

The app signs you in automatically the first time you open it, so you can use it without creating an account. If you want to keep a closet, you create a real account by signing in with Apple or Google.

  • Keep your login details to yourself. You are responsible for what happens on your account.
  • One account per person.
  • Give us accurate information, and keep the email address on your account working. It is how we reach you.
  • You can delete your account at any time from Settings. Deletion is permanent and removes your data as described in the Privacy Policy.

4. Your photographs and other content#

You keep ownership of the photographs you take and anything else you put into Bidstitch. We do not claim to own them.

To make the app work, we need your permission to handle them. By uploading a photograph or other content you give us a worldwide, non exclusive, royalty free licence to host it, store it, copy it, resize it, and transmit it, and to send it to the AI service providers we use, for these purposes only:

  • running your scan, meaning identifying the piece and estimating its value;
  • storing and showing the pieces you save to My Closet and your history, including making thumbnails;
  • producing the taste profile and collection score that describe your collection;
  • generating a share card when you choose to share something; and
  • operating, securing, backing up, and troubleshooting the service.

This licence exists to run the app for you, and nothing else. It ends for a given photograph when you delete the piece it belongs to, or when you delete your account, except for copies that may sit in routine backups for a short time before they are overwritten.

We do not use your photographs to advertise to you or to anyone else, and we do not sell them. Our AI providers handle what we send them under their own terms, which the Privacy Policy identifies.

You promise that the content you upload is yours to upload, that you have the right to give us the licence above, and that it does not infringe anyone else’s rights.

Please do not photograph other people. Bidstitch is for photographing clothing. If a photograph you upload shows another identifiable person, you are responsible for having their permission.

5. What you may not do#

Do not:

  • use Bidstitch for anything illegal, or in a way that breaks the law where you are;
  • upload content that is unlawful, that infringes someone else’s rights, that is sexual content involving minors, or that is abusive or harassing;
  • upload photographs of people who have not agreed to it;
  • present a Bidstitch estimate as an appraisal, an authentication, or a professional valuation, to anyone, for any purpose;
  • misrepresent our estimates when selling an item, or imply that Bidstitch has verified or endorsed a piece;
  • create more than one account, or create accounts automatically;
  • use bots, scripts, scrapers, or automated tools against the app or our servers;
  • try to get around the app’s limits, reverse engineer it, or interfere with its security;
  • overload the service, or use it in a way that costs us money disproportionately, for example by submitting scans in bulk automatically; or
  • resell or redistribute the service or its output as your own product.

6. Availability and changes#

We are building this app and we change it. We may add features, remove features, change how identification and valuation work, change which AI model is used, or change the app entirely. We may also suspend or stop the service.

Bidstitch is provided as it is. We do not promise that it will always be available, that it will be free of errors, or that any estimate will be accurate.

The app is free to use today. We may introduce paid features, subscriptions, or usage limits in future. If we do, we will tell you before anything you use starts costing money.

7. Ending your access#

You can stop using Bidstitch at any time, and can delete your account from Settings.

We may suspend or terminate your account, or remove content, if we reasonably believe you have broken these terms, if your use puts the service or other users at risk, or if we are required to by law. Where it is reasonable to do so we will tell you why, but we may act first when the situation calls for it.

If your account is terminated, your data is handled as described in the Privacy Policy.

9. Our intellectual property#

The Bidstitch app, its name, its design, and everything in it other than your own content belongs to us or to our licensors. You may use the app for your own personal, non commercial use. You may not copy it, modify it, or build a competing product from it.

The identification text, estimates, and share cards the app generates for you are yours to use for your own personal purposes, subject to section 5.

10. If someone else’s rights are infringed#

If you believe content in Bidstitch infringes your copyright or another right, write to help@bidstitch.com with:

  • what was infringed, and enough detail for us to identify it;
  • where in Bidstitch you saw it;
  • your contact details;
  • a statement that you believe in good faith that the use is not authorised; and
  • a statement that the information you have given is accurate, and that you are the rights holder or authorised to act for them.

We will look into it and remove content where the complaint is well founded. We will also terminate the accounts of people who repeatedly infringe.

11. Disclaimers and limits on our responsibility#

Read this section. It limits what you can recover from us.

Bidstitch is provided “as is” and “as available”, without warranties of any kind, express or implied, to the fullest extent the law allows. We specifically do not warrant that the app will be uninterrupted, secure, or error free, that any identification will be correct, or that any estimated value will be accurate, reliable, or achievable.

We are not responsible for:

  • decisions you make on the basis of an estimate, including buying, selling, insuring, valuing, or declining to buy or sell an item, or money you lose as a result;
  • the accuracy of anything an AI model produces;
  • content uploaded by other people, or anything you do with a share card; or
  • any failure caused by something outside our reasonable control.

Our total liability to you, for everything arising out of or connected with Bidstitch, is limited to the greater of the amount you have paid us in the twelve months before the claim or USD 100. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost opportunity, even if we were told they were possible.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, and for fraud. If you are a consumer, you may have rights under the law where you live that these terms cannot take away, and nothing here affects those rights.

12. App store terms#

You get Bidstitch through the Apple App Store or Google Play, and their terms apply to you as well as ours. The following applies to the version you got from the Apple App Store.

  • These terms are between you and Bidstitch App Inc. only, and not with Apple. Apple is not responsible for Bidstitch or its content.
  • Your licence to use Bidstitch is a non transferable licence to use it on any Apple branded product that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
  • Apple has no obligation to provide any maintenance or support for Bidstitch. If you need support, contact us at help@bidstitch.com.
  • Apple gives no warranty for Bidstitch. If Bidstitch fails to conform to any applicable warranty, you may notify Apple and Apple will refund any purchase price you paid for it. To the maximum extent permitted by law, Apple has no other warranty obligation of any kind in relation to Bidstitch.
  • We, not Apple, are responsible for addressing any claim you or anyone else has relating to Bidstitch, including product liability claims, any claim that Bidstitch fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar law.
  • We, not Apple, are responsible for investigating and resolving any claim that Bidstitch infringes someone’s intellectual property rights.
  • You confirm that you are not located in a country subject to a United States government embargo or designated as a terrorist supporting country, and that you are not on any United States government list of prohibited or restricted parties.
  • You must comply with any applicable third party terms when using Bidstitch.
  • Apple and its subsidiaries are third party beneficiaries of these terms, and on your acceptance of them Apple has the right, and is deemed to have accepted the right, to enforce them against you.

13. Changes to these terms#

We may update these terms. If we do we will change the date at the top. If a change materially reduces your rights, we will make that clear rather than burying it. If you keep using Bidstitch after a change takes effect, you accept the new version. If you do not accept it, stop using the app and delete your account.

14. General#

  • If any part of these terms cannot be enforced, the rest still applies.
  • If we do not enforce something straight away, we can still enforce it later.
  • You may not transfer your rights under these terms to someone else. We may transfer ours, for example if the business is sold.
  • These terms, together with the Privacy Policy, are the whole agreement between us about Bidstitch.

15. Governing law and disputes#

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws rules. Any dispute arising out of or relating to these terms or to Bidstitch goes to the state or federal courts located in Delaware, and you and we agree to the jurisdiction of those courts.

If you are a consumer outside the United States, nothing in this section takes away the protection of the mandatory laws of the country you live in, or your right to bring a claim in your local courts where the law gives you that right.
